The canon law of the Catholic Church influenced the widespread law through the medieval period through its preservation of Roman law doctrine such as the presumption of innocence. In civil law the sources recognised as authoritative are, primarily, legislation—especially codifications in constitutions or statutes passed by government—and custom. Codifications date back millennia, with one early example being the Babylonian Codex Hammurabi. Modern civil law methods essentially derive from legal codes issued by Byzantine Emperor Justinian I within the 6th century, which have been rediscovered by 11th century Italy. Roman law in the days of the Roman Republic and Empire was closely procedural, and lacked an expert authorized class. Decisions weren’t published in any systematic method, so any case law that developed was disguised and almost unrecognised. Each case was to be determined afresh from the legal guidelines of the State, which mirrors the unimportance of judges’ selections for future cases in civil law systems at present.
